Minutes of the August 1, 2005 Meeting

Meeting was called to order at 7:33 p.m. by Chairman Larson

Update on Tree City Project

Natural Resource Inventory for the Town of Lyme
Vicki Davis spoke with Tara Banford from Upper Valley-Lake Sunapee Regional Planning Commission about potential money to commission an NRI for Lyme. There will be a meeting with a potential contractor and Lee will alert commission members when a date/time/location is arranged.

Update on Post Pond water level issues
Dick Jones reports that a hearing for Loch Lyme Lodge’s Motion for Temporary Relief was held at Grafton Superior Court on Monday, August 1. The presiding judge (Vaughn) heard testimony from all parties and closed the hearing with a statement that his ruling would be issued soon. Dick offered notes from the hearing. Pertinent deadlines if the case proceeds include: interrogatories provided by 11/1/05; completion of discovery 3/15/06; settlement conference after 2/1/06; and trial date after 4/15/06.

Lee included here that the state lakes assessment staff will be monitoring water quality in Post Pond in the first week of August.

The agreement between Town of Lyme and the Day’s for Right of First Refusal on the sale of their property was ultimately rejected by Jeanette (sp?) Day. There will be no agreement for this property.

Wetlands
Three site visits were completed in June and July: Barnum (River Rd.), Kinsler/Johnston (River Rd.), and Hoover (Baker Hill Rd.). Each had several CC members attending and no problems were found with any of the associated proposals. Lee sent letters to each stating the CC’s position on their respective proposals.

Two site visits have been requested: Colby and Jane bent have requested a site visit to their property on River Rd. for construction of a small walking bridge in a wetland. ZBA has requested site visit to land behind Dowd’s Inn where a shed has been relocated. Both visits are scheduled for Monday, August 8 at 5 p.m.

Lee reports that there has been a landowner request to amend a conservation easement on 3         twenty acre lots with 3 potential house locations. The amendment would eliminate one of the potential house lots allowed by the easement. Lee asks if Dick thinks the Select board will want advice from the Cons Comm. Dick suggests that the Selectboard will seek advice from the Cons Comm and will wait for further information from the landowner.

New Business
Armstrong easement is proceeding. Armstrong’s have requested $500 from the Cons Comm to support legal expenses incurred. Motion to approve $500 by Adair Mulligan, second by L. McDaniel, motion passes with unanimous vote. $500 will come from the Town’s Conservation Fund to support Armstrong easement.\

Dartmouth Skiway has submitted plans for improvements to the Skiway. Lee has copy of current plans. Nothing in the plans needs CC comment – all applicable permitting will be done through DES.

CC is helping recruit for Upper Valley Trails Alliance trails workshops in the fall. Both Lee and Matt will be leading trails-related workshops in September.

Water quality results and explanation will be posted on the town website.

Next meeting will be held on September 12 (2nd Monday)
