The Town of Lyme is proud to be a leader in the granting of Historic Agricultural Structure Discretionary Preservation Easements under RSA 79-D. This legislation recognizes that New Hampshire’s old barns and other farm outbuildings are important local scenic landmarks. It provides for the granting of discretionary easements of 25% to 75% for agricultural structures that are at least 75 years old. We developed a checklist that considers the following factors in deciding the amount of the easement to be granted: 1) the scenic quality of the structure, 2) the public’s
access/participation in enjoyment of the structure, 3) the structure’s historical importance, 4) its condition, and 5) the public benefit to be obtained versus the tax revenue lost if an easement is granted.
